Subscriptions, cancellation and refunds

1. SUBSCRIPTIONS

Evermoves offers:

  • monthly subscriptions (membership: the on-demand library, every series, and the Sunday LIVE stream);
  • annual subscriptions, when offered;
  • promotional memberships, when offered;
  • in-person class visits (a casual visit or a class pack);
  • physical goods from our online shop.

evermoves membership is a one-month auto-renewing subscription unless a different term is clearly shown at purchase.

2. CHANNELS AND WHO YOU PAY

Membership is sold on two channels. The price is not the same on both, and the merchant of record is not the same.

  • Website and the member site in a browser (web). You buy from evermoves. We charge you through Stripe, our payment processor. evermoves is the merchant of record. The price is the web price shown at checkout.
  • iOS app (App Store). You buy from Apple. Apple is the merchant of record for that purchase. Apple charges your Apple Account. evermoves receives subscription status and an opaque transaction identifier so we can unlock membership on your account. The price is the App Store price shown by Apple at purchase (StoreKit), not the web price.
  • Android app. Membership cannot be purchased in the Android app. The app can show whether your membership is active, ending, or expired. It does not sell membership and does not show a membership price.

Class packs (in-person visits) and physical-goods shop items are separate products. They are not membership. See /legal/refunds.

You cannot hold two live memberships on the same account (one via Stripe and one via Apple) at the same time. If you already have a live App Store membership, we will not start a web membership against that account, and the reverse.

3. FEES AND AUTOMATIC RENEWAL

Subscription fees:

  • are payable in advance;
  • renew automatically at the same frequency (monthly, unless a different term is shown) until you cancel;
  • are charged using the nominated payment method for that channel (Stripe on the web; your Apple Account on the App Store).

By subscribing, you authorise the merchant of record for that channel to automatically charge the nominated payment method for each renewal period until you cancel.

Australian Consumer Law. Before you confirm a purchase we show you: the name of the subscription, that it is one month (or the term shown), the price, that it renews automatically until cancelled, and how to cancel. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law.

Web (Stripe). Before you confirm, we show you the web price, the billing frequency, and that it will renew automatically until cancelled. You can view your next renewal date and cancel at any time from Account → Billing.

This subscription renews automatically at the price and frequency shown until you cancel. Cancel any time from Account → Billing — no lock-in contract.

App Store (iOS). Apple shows the App Store price at purchase. Apple charges your Apple Account for the initial period and for each renewal, including within 24 hours before the current period ends, until you cancel. Cancelling on the evermoves website or in Account → Billing does not cancel an App Store subscription. Cancel in iOS Settings as set out in section 4.

evermoves membership (one month). This subscription renews automatically through your Apple Account at the price shown until you cancel. Cancel any time in Settings → Apple Account → Subscriptions, at least 24 hours before the current period ends.

The Apple paywall string above is written to satisfy App Store Review Guideline 3.1.2(a) (title, length, price shown at purchase, renews until cancelled, cancel at least 24 hours before period end) together with Australian Consumer Law auto-renewal disclosure. The numeric price is never hard-coded here: Apple displays it at purchase.

4. CANCELLATION

You may cancel at any time. Cancellation:

  • prevents future billing after the current paid period;
  • does not itself generate a refund for the current billing period unless required by law (see /legal/refunds);
  • leaves access in place until the end of the period you have already paid for, unless a refund or revocation takes effect earlier.

How to cancel depends on where you bought:

  • Web / Stripe membership: Account → Billing, or the Stripe customer portal linked from there.
  • App Store / iOS membership: cancel in iOS Settings → Apple Account → Subscriptions (or the equivalent Apple Account subscriptions screen on your device). evermoves cannot cancel an App Store subscription for you. Deleting the app or deleting your evermoves account does not stop Apple billing.

Cancel at least 24 hours before the end of the current period if you do not want Apple or Stripe to charge the next period.

5. REFUNDS

See our standalone /legal/refunds (Refunds & Credits Policy) for the full position. In summary: nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law. For App Store purchases, Apple decides refunds and you request them through Apple; evermoves cannot reverse an App Store charge.

6. PRICE AND PRICE CHANGES

The membership price differs by channel. The App Store price is higher than the web price because Apple charges a commission on App Store purchases; the web price is charged by Stripe on our behalf. Any comparison between the two must state both current prices, must be true at the time it is made, and must never appear inside the iOS app (see legal/advertising-and-testimonials-policy.md). We do not publish a fixed percentage saving — the difference is calculated from the live web price and the live App Store price.

Evermoves may change the web subscription price with reasonable notice. An App Store price change is processed by Apple under Apple’s price-increase rules (including any consent Apple requires). A change on one channel does not automatically change the other.

7. SUSPENSION

Evermoves may suspend accounts for:

  • failed payments;
  • fraudulent activity;
  • breach of Terms of Use.

If an App Store renewal fails, Apple may offer a billing-retry or grace period. While Apple reports that grace, we keep membership access. If Apple reports the subscription expired or revoked, access ends.

8. TERMINATION

Evermoves may terminate subscriptions at its discretion for breach of these Terms. Terminating your evermoves account does not cancel an App Store subscription — you must still cancel in iOS Settings if Apple is billing you.
